I. SCOPE OF APPLICATION
1. the following General Terms and Conditions apply to all accommodation contracts concluded between Klodt Grundstücksverwaltung GmbH und Co KG (‘Landlord’) as the operator of Refugium Emsdetten and third parties (‘Guest’). These terms and conditions also apply to all other services provided by Refugium Emsdetten.
2. the subletting or re-letting of the flats as well as the use for a purpose other than the agreed purpose require the written consent of the landlord.
3. deviating conditions shall only apply if this has been agreed in writing.
II. CONCLUSION OF CONTRACT, CONTRACTUAL PARTNER
1. the contract is concluded when the landlord accepts the reservation of the respective flat made by the guest.
2. if a third party has booked for the guest, the third party shall be liable to the landlord together with the guest as joint and several debtors.
III PAYMENT
Payments shall be made by bank transfer, PayPal or Maestro/credit card, unless otherwise agreed in individual cases.
IV. CANCELLATION BY THE GUEST (CANCELLATION)
Bookings can be cancelled up to seven days before the date of arrival. Bookings with the standard rate can be cancelled free of charge up to seven days before the date of arrival.
V. PROVISION OF FLATS
Booked flats are available to the guest from 3.00 p.m. on the day of arrival and until 10.00 a.m. on the day of departure.
VI. HOUSE RULES, LIABILITY OF THE GUEST
1. smoking is prohibited in the Refugium Emsdetten. In the event of an offence, the landlord may demand a flat-rate compensation of 1,000 euros from the guest. The guest reserves the right to provide evidence of lower damages and the landlord reserves the right to provide evidence of higher damages.
2. any kind of celebrations are prohibited in the Refugium Emsdetten. In the event of a violation, the landlord may demand a lump-sum compensation of 5,000 euros from the guest. The guest reserves the right to provide evidence of lower damages and the landlord reserves the right to provide evidence of higher damages.
3. if the guest commits legal offences when using the internet access of the Refugium Emsdetten, he must indemnify the landlord against any claims by third parties.
4. in the event of loss or damage to the access token issued to the guest, the guest shall pay the landlord 50 euros.
VII. FINAL PROVISIONS
1. the online dispute resolution platform of the European Commission can be accessed via the following link: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.show&lng=DE. The landlord does not participate in a dispute resolution procedure before a consumer arbitration board and is not obliged to do so.
2. place of fulfilment is Emsdetten. For merchants or persons who do not have a general German place of jurisdiction, Münster is agreed as the place of jurisdiction. Otherwise, the statutory place of jurisdiction shall apply.
3 German law shall apply.
